Public Hearing for James Dennin four-lot subdivision on Airport Road drew no comments. A conditional Final Approval was granted.
Public Hearing held for Kevin Mahoney two-lot subdivision on Cedar Drive Road. Comments from the public included requests for no further subdividing the previously subdivided property; water concerns; cutting of trees seen as loss of quality of life issue. Chairman Fornal explained that the deed restrictions referred to were misinterpreted by the public as the actual wording read: "no further subdivision without Planning Board approval." As for the water and tree-cutting issues, it was explained to the public that Mr. Mahoney was within his rights to develop the property as presented. The Chairman also mentioned to the public that the Code of the Town of Rochester was being reworked and the public's comments will help in creating a better Code. The Planning Board then issued a Conditional Preliminary Approval followed by a Conditional Final Approval (seeing as Mr. Mahoney had already fulfilled the conditions for CPA).
Public Hearing for Aquarius Star Corp. c/o Joseph Esposito for a Special Use Permit to build a 3-unit residential building off Lucas Avenue. There was no public comment. The Planning Board went over a letter from the Ulster County Highway Department which recommended sharing a driveway with contiguous property also owned by the applicant. A conditional Approval was granted.
A Pre-Application presentation was given by applicant Mark Rushfield for a Special Use Permit to open a Bed and Breakfast on Berme Road. The Planning Board went over the specifics of the applicant's plan and offered suggestions as to how to go about fulfilling Code and New York State law.
