Dawson Homes, Inc subdivision known as Mount Laurel Estates; Samsonville Road
A request was made by applicant to extend the time frame (per Code) by six months. The Chairman informed the applicant that the Town Attorney suggested withdrawing Phase Two and Phase Three from the application (that received Conditional Preliminary Approval in September 2006) so that Conditional Final Approval will pertain to only Phase One. Chazen planning consultant Jan Johannessen wanted to contact the town attorney to discuss the phasing issue. The Planning Board granted Mr. Dawson a three month extension; he has one more three month extension available.
William Damberg; proposed 2-lot subdivision in the Queensmont Estates subdivision.
The applicant violated a conservation easement by constructing a driveway through the easement and received a permit from the town's Highway Superintendent to do so. Seeing as the original intent was to preserve the waterfall view and wishing to cause the least disturbance to the creek, the easement requirement that the property be accessed via a bridge was waived. The town attorney is looking into exactly how the Planning Board will remove the conservation easement from maps filed with town and county. The action was typed Unlisted per SEQR.
Taroh Holding; David O'Halloran for 3-lot subdiv; Old Mine Rd; Industrial District
The applicant was informed by the Chairman that creating three lots from an "I" zone lot would, in all likelihood, require the applicant to go to the Town Board for "I" zone designation for two of the three lots as each "I" zone use must receive "I" zone designation by Town Board. The town attorney will be contacted for confirmation. The action was typed Unlisted per SEQR
Ledge View Properties, LLC c/o Frank Dunn; regarding Lot Line Adjustment
The applicant wished to move a lot line to coincide with a ledge rather than bisect ridge. The action was typed Unlisted per SEQR. A public hearing was scheduled.
Homeland Towers, Review Discussion
The Planning Board reviewed Chapter 130 Telecommunications, a letter dated 5 February 2007
from Homeland attorney Robert Gaudioso of Snyder & Snyder, LLP as well as a model law from New York Planning Federation dealing with siting of wireless communications towers. The board, by a vote of 4-1, approved an amended review for two cell towers to be placed on municipal property. During the subsequent review, the town's professional planners (Chazen Companies) will assist the Planning Board.
